Tekashi 6ix9ine‘s kidnapper is asking to be let out of jail and into home confinement because he has asthma and is especially at risk during the coronavirus pandemic, according to a letter filed in court.

Anthony “Harv” Ellison, a reputed member of the Nine Trey Gangsta Bloods and former bodyguard for Tekashi, was convicted in October of kidnapping the rainbow-haired Brooklyn rapper in July 2018.

Lawyers for Ellison — who is in jail awaiting sentencing in the case in which he was also found guilty of racketeering conspiracy — are asking a judge to release him from the Metropolitan Correctional Center on $200,000 bail and home confinement, according to a Manhattan Federal court filing.

Ellison has asthma and “given the outbreak of COVID-19 at the Metropolitan Correctional Center (MCC), Anthony’s health and welfare is in great peril,” his lawyers wrote to Judge Paul Engelmayer.

Ellison — who is set to be sentenced on June 19 — hasn’t been able to adequately social distance or sanitize during the health crisis.

For instance, inmates are not able to maintain 6 feet of distance from each other — plus inmates all share bunks, sinks, toilets and showers with other inmates, the letter says.

Ellison’s unit has received an inadequate amount of soap for showers and clothes-washing and inmates have not been allowed to buy extra, the letter says.

Ellison also hasn’t been able to see his lawyer for over a month — all while he’s supposed to be preparing for sentencing — which his lawyer says violates his constitutional rights.

Tekashi — given name Daniel Hernandez — was arrested for racketeering in 2018, but he cut a plea deal and became a government cooperator before spending three days testifying against his former Bloods pals.

The “Gummo” rapper testified at the time that he was beaten and robbed of his expensive jewelry, including a $95,000 diamond-encrusted My Little Pony chain, before he was dropped off in rival gang territory.

A spokesman from the US attorney’s office declined to comment.
